The class actions are still around. They have not gone away. But many investors think that the company will pay for class action settlements. It is often the insurer that pays the majority of the settlement. So class actions are usually cited by down rampers to scare holders into selling. The main problem with class actions is less about the financial cost, and more about management resources being taken away from its core business.
