Depending on how this plays out, I am not sure management will control the outcome of this situation. Senegal Government will have a major say in how this plays out. IF it goes to arbitration, then it will be the legal arguments from both sides that will sway the outcome and how the operating agreement is worded.
All management can do is obtain good legal council under these circumstances.
I think you are trivialising what is actually a very complex problem for all parties.
Management can only be responsible if they are able to extract something from WPL in the event they do not pursue PE - then you can argue whether they got a good deal or not. Large investors are certainly not banking on PE - they are investing in FAR for what is already known.
To try and 'blame' management if PE fails is not being realistic IMO.
