Remove that statutory defense from the legislation and what choice would the cops have if a complaint was made other than to charge both with statutory rape(I assume that would be the charge)? And what choice would a judge have, given they have to apply the law as it stands? It's VERY obvious to anyone who bothers to think about the realities of teens engaging in sexual activity that there needs to be protections so that consenting teens of similar age are not subject to draconian laws meant to stop adults abusing children.
