A number of matters have been raised with ASIC in relation to CLZ however investigations have failed to proceed because the matters have not met the initial “public interest” test, which guides how ASIC prioritises the allocation of its resources.
With ASIC and ACCC experiencing such a poor strike rate in recent years they must manage the allocation of their resources judiciously, regardless of how compelling any evidence may be.
