I am almost certain you would not describe FAR as AP have in this annt. I'm also certain that FAR wouldn't be committing to the money.
TBH I'm not sure why AP would put out such a detailed announcement let alone and annt at all. This to me looks like a non disclosure agreement and most don't get disclosed until a contract is executed.
AP imho have announced the exclusive agreement because they're in trouble. The other party would not be happy about this annt.
