The court case is a red herring. If anything is only going to enhance a2mc's position in the market. More noise = free advertising whether they win or not. But as already stated its not about the science, although it does give a great platform for a2M to leverage their brand, as ultimately discussion around the differentiation is inevitable. Its the opportunity that a2mc has being praying for.
10% of the Australian market are not dumb enough to pay a premium for a2 milk they don't believe adds any value nutritionally, health wise, or even psychologically. Plenty of anecdotal evidence will be available to the court apart from scientific (if it even goes there) to prove there is a reason to protect the brand and differentiate it against standard milk which while having a2 protein is not pure a2 protein. That's the issue.
