A reminder, folks, that the a2 Milk Company is looking for details of consumers who have been deceived into purchasing milk labelled “A2 Protein” and suchlike, as marketed by Lion and its subsidiaries including Pura, Dairy Farmers, etc

Numerous posts have been filed on this forum over recent weeks by certain contributors trying to deter consumers from submitting their complaints. They have suggested it will be a pointless exercise and not taken seriously by the court, but this is completely false and misleading.

The deception of consumers was very clear, but specific examples of the experience of individual consumers will be needed. The more the better, the bigger damages will be recovered by A2MC.

It does not matter whether a complainant is a shareholder or not. This is a CONSUMER issue, and all Australians have the same rights to protection under consumer law as anyone else, regardless of shareholder status.

Specifically, the court will be interested in examples of consumers wishing to purchase A2-only milk who were tricked by the heavy labelling on Lion’s containers.

The law states clearly that what matters is the general impression created by the main labelling. It also states that a consumer is not expected to search the “fine print” elsewhere for more accurate details of the contents. It is not their fault as purchaser if they failed to do this.

There is time yet for more new examples of deception to be forwarded. Products with the misleading labels are still being sold, and still being bought by consumers who are possibly quite unaware of the deception, According to the court’s timetable, evidence is still being collected and this will continue for several weeks yet. But obviously, the sooner the better.
