A lawyer takes instructions from their client.
I suppose Bishop could've refused the work and let someone else take it on. The case still would have run the same course through the courts.
Like it or not we have an adversarial legal system in Australia, insurers and companies will use whatever they can to avoid paying out and litigants will likewise use every angle they can to maximise their chances of winning.
I don't think it's fair or reasonable to single out 1 person who did legal work years ago for a particular client, and say what they did was wrong, when all they were doing was following their clients instructions. Unless she knowingly mislead the Court or her client, it's what lawyers have to do. Even Julia Gillard.
It must challenge their morality all the time. Think of a criminal defence laywer who knows or suspects their client is guilty. They still have to provide a robust defence and do everything in their skill to try and have the person either aquitted, or their sentance mitigated as low as possible.
