    It is obvious why a class action cannot succeed against any company unless it has no capacity to recover.

    Provided the company is still in business, a pitifull share price now can rise to above what its its previous highs were and there would be no grounds for shareholders to grizzle.

    There are far worse examples than CMQ of directors acting against shareholders' interests, and quite deliberately too. Alinta and Qantas come to mind, where the directors schemed to sell the company out from under shareholders' noses for personal gain, but because the companies are profitable no one has (yet) seriously considered embarking on taking class action.
