To the members of the Nkwe board ... You need to read this, and decide if your current refusal to negotiate with our organised minority group is in your best interests :-
Abraham Li has been the MD of tbe board since Zijin took control of it a few years back. It is he who has been at the helm while Nkwe has taken various actions which have potentially landed you all in serious legal trouble.
The questions from the ASX have only just started, and the spotlight being directed at you from them ( and soon to be ASIC as well ) will get a hell of a lot more intense very quickly ... The minorities are about to launch a class action against you, and if you honestly don't know how legally weak your defence is, then it must be due to arrogance, denial, or both ... and I recommend that you should probably seek alternative legal advice immediately ... This won't help your defence, but it might finally make it clear to you just how shaky the ground is on which you stand.
Understandably, Abraham Li, under whose watch this growing disaster has taken place, would probably be feeling particularly uneasy about his role in it all ... For Nkwe to try to blame everything shady that has taken place on previous management is a very weak response to the questions being asked of you ... Surely you all know that it is often the covering up of a wrong-doing which has the most serious legal consequences, and Abraham has been the MD whilst this potential covering up has occured. Whilst this is all unproven right now, you have very little time left before ASX, ASC and the Minorities' legal team will force the truth to be revealed.
There were strong rumours recently that Abraham Li has fallen out of favour with his superiors due to his handling ( or non-handling ) of the escalating situation with minorities, and that he is a dead man walking, just waiting to be moved out of Nkwe ... These rumours were denied by the board ... but I can certainly understand why they started ... and where there is smoke there's often fire.
So I ask you all, board members and managers of Nkwe ... Is it Abraham who is calling the shots and refusing to do the smart thing and deal with minorities ? .. I have already pointed out that due to his position as MD, he would understandably be feeling most uncomfortable about the state of affairs you all now find yourself in. But IF those feelings and his pride are causing him to bury his head in the sand and hope the trouble just goes away, do you really want his refusal to face reality lead you all into potentially expensive and career-damaging trouble ?
I ask IF, because I can't say for sure why your board has been so foolishly reluctant to negotiate with minorities while you still can ... But if I am right, then the rest of you have the power to get together, do the wise thing, and bring yourselves to the table immediately.
