Yes, that looks quite bad for the ACCC. If their goal was to prove that TPG would be willing and capable of creating a high-quality 4th network, they are losing.

It's becoming very apparent that TPG's network would be substandard and patchy. It is also apparent that despite how much TPG wanted it, there would be financial and technical issues. The ACCC will need a bombshell to win the case at this point imo, but I'm no legal expert!
