HS - not sure if you are referring to the intervention as a whole or just the new contentions.
You may be correct with the NEW contentions but the NRC has only objected to two of the original four contentions - so irrespective of what the ASLB thinks of NRC staff's submission, the Hearing will continue on the basis of at least two contentions.
You will also recall that, in early 2012, the NRC appealed against most of the intervenors' contentions but the ASLB upheld the majority of them.
So clearly the ASLB is not there just to pander to the NRC staff's views.
We will just have to wait and see how many contentions go to court - six, two or somewhere in between?
