Yeh they would probably need to substantiate it some how - likely with metrics, or getting imec and WD to confirm... which is not in WD's interest.
And perhaps 4DS is trying to 'surprise'/ shock other parties when they finally give them "show-and-tell" chips such that it heats up speculation amongst them all of a buy out situation and wanting to be the first in to secure it... Don't show your cards until you have to type of thing.
