It didn't go to trial because AGS withdrew.
Settlement implies AGS got something out of it. Clearly they did not.
This is Hoffman's take on his profile page:
"Action seeking to set aside an agreement to extent the earn in period in respect of EL2874 by reason of alleged breaches of contract, fiduciary duties, breach of equitable duty of confidence, misleading and deceptive conduct. Discontinued on morning of 2 month trial. Respondents party/party costs paid"
Looks to me as he's promoting it as a win of sorts. I.e AGS backed down
Compare that to:
"Challenge to validity of determination of chair of Joint Venture Management Committee. Claim dismissed. Proceedings alleging breaches of alleged fiduciary duties arising out of entry into a Native Title Mining Agreement resolved."
Resolved implies AGS got something out of it.
