Yes the person who voided the contract would be found liable. If she knowingly granted you access to drive the car, arguably she is responsible. In the AirBNB scenario, the owner is totally in the dark, the person responsible, is quite clearly you. It is the equivalent of your spouse saying she can drive you somewhere (but explicitly stating you cannot drive yourself).. but then you driving without her consent anyway.
