It was this original interaction between Counsel Tran and Justice Kelly that sealed the deal for me. Tran was under no obligation to make Justice Kelly aware of Minister Hawke's intention to use his discretion to remove Djokovic because that discretion was always there. There will be those who say the government waited until Friday afternoon to release the announcement. I'm not so cynical. Now, I return to my original questions: Is this a reasonable use of power and if he has been economically harmed by the Federal Government, could he be awarded more costs?
