In 2014 MBN had very high production cost and couldn't pay around $35M per year interest on the $395M USD loan, they had one outstanding and another due when they went into VA. So these unsecured creditors done the DOCA otherwise MBN would have had to filed for bankruptcy and everyone losses (especially them....interesting), as they did try to sell the mine and most bidders said they couldn't see MBN being cash flow neutral and that was when PoN was at $8US/lb but their production cost was just as high.
