The whole issue of patents is a real dog's breakfast in the RNAi field. There are literally thousands of patents issued or applied for. When companies start making some real money out of the technology, I can see lawsuits flying left, right and centre in an effort by each assignee to claim their piece of the action. It is only when decisions have been made by the courts that we will be sure which patents have precedence over others where none is currently acknowledged.
One only has to look at what happened in Europe with the Graham patents to see the lack of consistency in the application of patents. Just think what will happen when billions of dollars are on the line.
As far a BLT is concerned, I would be more worried about the new patents assigned to Gradalis and those of CSHL before I worried about Alnylam's.
