Surely this will not be a major issue for APT, any reasonable person would scope the legal/regulatory environment before establishing a business such as this. Even given APT was outside the scope of ASIC it surly would have been clear they are on the fringes and would have designed business processes/it capability to accommodate an the inevitable expansion of ASIC scope. Also being proactive and engaging early gives APT an advantage in that they may be able to influence the regulations to sell me extent.
