Patents only apply in the country in which they are granted. A Chinese patent not filed in the USA has no effect in the USA, other than to establish "prior art", which would prevent a USA company from being granted a patent covering the same idea.
So, the slightly refined ore could be transported to any country where the Chinese do not have coverage and a refining plant could be built using the exact art as described in the Chinese patents and they could sell the finished REE's into any country OTHER than countries where the Chinese had patent protection.
There is no such thing as the Patent Police, so each patent owner has to find infringers at the patent owner's expense and bring them to court where there is proper standing and jurisdiction.
