A couple of other considerations for both parties would be 1. No big lump sum payout, so I guess the CA lawyers would take a haircut 2. The time take to settle each planners grievances would drag on 3. Both parties may prefer to get the matter done and dusted and actually come to an agreement (both sets of lawyers agreeing to a compromise). If an independent compensation committee was set up with a set amount of funds (this is the tricky part) I’d assume some type of priority system would be set up to consider each case on its own merits.
