Questions from a couple of concerned Opes cleints I know:
1. Does anyone have an opinion of Justice Finklestein's eagerness to preside over the case and for ANZ's eagerness to move the two NSW cases to Melbourne's federal court? Should we have an uneasy feeling about Justice Finklestein's offer to preside over a test case when he set the question rather than the plaintiff setting the question. There was also clearly inadequate time for Beconwood's small legal team to prepare the case with
such a short notice. However ANZ has a huge legal and can basically prepare their case overnight.
2. One of the "big 3" litigators did advise that they hope he doesn't preside over further cases because apparently he is a very difficult man to present to and he is generally set in his ways.
