The sooner this issue gets the the Federal Court the better. While I think the result will be that while Opes may have mislead their clients, the courts will find that the lending contracts between ANZ and Opes were rock solid and cut to the very basic of contract law in Australia. ANZ have acted on that basis and it will be very hard to overturn that without putting at risk the accepted principles of ownership law in Australia.
That being said the whole debacle is a mess. At the very least it has highlighted some of the dubious practices of stockbroking companies.
