Whatever course the legal proceedings take ANZ are in trouble:
If it's proved a margin loan. Then no clean title to ANZ they have to return stock and/or get sued
If it's proved an AMSLA. ANZ did not provide the collateral (100% value plus margin) with Opes nor Opes to client. ANZ in trouble with ASIC re sub shareholder notices. ANZ in trouble with ATO re capital gains tax issues. If it can be proven ANZ reviewed and gave the OK to Opes docco ANZ in BIG BIG trouble for fraud and will get sued by Opes clients.
Is there any way that ANZ get away scott free?
