Friday, December 30, 2022-The President of the Republic, Félix Antoine Tshisekedi Tshilombo signed a series of presidential ordinance including that relating to the collective measure of presidential pardon.
According to article 1 of this text, the remission of the sentence is granted to any person convicted of penal servitude or forced labor for less than 5 years by court decision which has become irrevocable on the date of December 31, 2022.
The second article stipulates that the reduction of the sentence of 5 years remaining to be executed is granted to any person sentenced to a penalty of penal servitude or forced labor equal to or greater than 5 years by court decision which has become irrevocable on the date of December 31, 2022.
With regard to the third Article, the commutation of the death penalty into that of penal servitude for life is granted to any person convicted by a judicial decision which has become irrevocable on the date of December 31, 2022.
Article 4 specifies that the commutation of the sentence of life penal servitude into that of 20 years of main penal servitude is granted to any person convicted by a court decision which has become irrevocable on the date of December 31, 2022.
The remission and commutation of sentence provided for in articles 1, 2, 3 and 4 below are not granted to convicted fugitives or latitants, to persons convicted of crimes against the peace and security of mankind and to the penalties provided for by the law provided for by law n ° 15/022 of December 31, 2015 modifying and supplementing the decree on the penal code
3. To persons convicted of the following offences:
– sexual violence
– embezzlement of public funds
– Corruption
– Concussion
– Other assimilated offenses (money laundering, financing of terrorists, assassination, murder, armed robbery, etc.
