In no way am I guaranteeing that A2M will get 3% of China's market.. in fact, one should question: Why is it that A2M could get close to 10% of the Australian market? The only explanation one could offer is that A2 is a differentiated brand and it's the only milk that can offer pure A2 protein at the moment and if it can capture 10% of Australia's market, one would wonder why it wouldn't secure 10% of China's market as well!
Yes, the patent could lapse, however, I'm sure the company is managing it in terms of putting in more patents to protect what other milk companies could claim on A2 protein content. And even if the other companies would want to do so, they are already quite a number of years behind to ramp up to supply pure A2 protein milk into the market. By that time, A2 would have established its brand solidly in the market. In other words, A2 has a First Mover's Advantage.
