One of Victoria’s most eminent lawyers has warned the state government’s controversial new pandemic legislation will give it “unlimited power to rule the state by decree”.
Christopher Blanden QC, the president of the Victorian Bar, has also accused the government of misleading Victorians over its consultation process in preparing the legislation, saying proper advice was never sought.
Mr Blanden said he had been inundated with calls by furious members demanding an explanation about his consultations over the “draconian” legislation.
But he said it was limited to a 45 minute online meeting with more than a dozen other stakeholders but details of the legislation was not discussed.
Mr Blanden said the way in which the Bill was being rushed through parliament was an attack on democracy.
“The bill confers on the health minister in a practical sense an effectively unlimited power to rule the state by decree, for effectively an indefinite period, and without effective judicial or parliamentary oversight,” he said.
“If the Stasi had these powers, they would still be in force,” he said.
