Some insight into SA old order mining rights compensation. Seems clear that all Anglo can look for withought a JV arrangement is compensation for its old order rights but even then only if the relevant conditions are met. Also seems that the compensation claim is to be filed against the ministry of minerals and energy.

Garatua therefore seems to be a much different (lower) risk than loss of Tubatse mining rights on community issues. Can understand PL statement that as far as NKP are concerned the issues with Anglo were sorted out in 2008. Looks like they now want the JV ahead of Xstrata?

It is all beginning to look like NKP/Genorah are really not at fault with what has happened but it is down to a real mess with the SA mining industry that better be sorted quickly otherwise SA can kiss good bye to any future investment in their industry. With PGM prices moving up there are still exploitable resources in Russia (especially palladium) and some resources in Australia that to date could not bee developed owing to poor economics.

The solution to these issues I can see coming from legislation and it could be rather swift!
