    I was also surprised to see the ASX dismiss the litigation as immaterial. Given the claims made by ISX, surely a loss raises questions about the ASX’s market licence and the inherent conflict between their commercial interests and their obligations as a licensed market operator? Could this impact future revenues or the carrying value of intangibles. Wouldn’t the possibility of these questions being raised be relevant to someone invested in or considering an investment in the ASX. Isn’t that the definition of materiality?

    It seems to me that it was both unnecessary and unwise to label the action immaterial. Imagine if, at some point, ASIC instruct the ASX to issue a market update clarifying the materiality of the litigation. Irony?
