He could do. But wouldn't the offer be higher if that was likely to be the case.
Remember the mushrooms weren't told what the damages case was seeking. AGS dropped all references to damages after their court action was first announcement. Now if you were running AGS and were trying to leverage a better offer out of Quasar wouldn't you make the damages you were seeking loud and clear to the market as well. That would help keep the share price buoyant and fundamentally increase the upward pressure on any offer, whether it be from Quasar or any other parties.
