I don't disagree in the slightest about the FDA's being pretty useless and incompetent.
However, it seems, at least heavily implied, that the companies can stay and operate beyond the deadline without this necessarily being contingent on change in legislation. Perhaps there will be an extension of the emergency discretion. I certainly don't know what is required in the legislative sense, I'm basing it off the FDA's promise of more information to companies on how they can stay.
By the way, I read today that there has been at least 160 applications to the FDA by overseas formula manufacturers thus far. Given that there looks to be only around 17 approvals thus far, I think it is fair to say the FDA is swamped and under-staffed for this process. And if A2M is approved soon it isn't exactly that late to the party in the scheme of things.
