    Further to my original post about causation issues, the Full Federal Court recently delivered a judgment in the appeal on the class action against CBA on 7 May 2025.

    Long story short, the court found there was a breach (of duties to shareholders), but the "class" failed to establish causation and loss as a result of the breaches.

    I believe the scorecard is 0-6 (class actions losing) in recent times.

    However, court gave clues about connecting breaches to losses (by potentially using analyst reports, news articles, and share price movement comparisons with competitors), which might help future actions.

    In the case of MIN, in my personal opinion, causation is still going to be a massive challenge. They would have to disentangle all the share price movements/changes that are as a result of whatever they plead to be the issue (I haven't seen the formulation of the claim).
