Pen does have an aquifer exemption, however the contentions are still being debated.

The sitting judge is even quoted as saying, water doesn't flow up hill (re PAM Viv case) & the monitoring wells create a hydrostatic zone of higher pressure (clean water) zone to contain the luxivant whilst being drawn from the production well(s)...Yet here we are 3 years later hammering out the last of the contentions.

The science doesn't support the petitioners, NRC/ agreement state is effectively the rule maker, yet headaches prevail.
