I've held that opinion for quite a while. If they can garner 90% of the company then they can mandatorily take over the rest. Not sure if they have to openly make a takeover offer before that kicks in or if it holds regardless. It would be nice if the SH were provided with full disclosure on all transactions and the current state of the company. After all it is a public company.
