Pretty much. I brought to their attention that they are not an eligible entity for an additional 10% placement capacity under ASX Listing Rule 7.1A because they are in the ASX300.
I must admit I was motivated by not wanting 25% further dilution this year. I couldn't think of a single possible situation where I'd be happy with PBT issuing more than 15% of the current shares on issue this year, given that there is enough cash already in the bank to finance:
- a smallish phase 3 HD trial (if necessary)
- a PD phase 1 trial
- planning & initiating next steps for AD
And as far as I can see, resolution #3 refreshes the ATM facility to the tune of 15% of the current shares on issue, this should be plenty if some extra cash is needed.
