What I was trying to say was that short term price movements aren't grounds for an independent expert to find that a proposed scheme isn't fair. Independent experts usually come up with a fair value range and as long the offer falls in that range then they can find it fair.
I didn't say that the expert wouldn't value this above $3 a share? Even the example numbers I used included a value above $3...
