Stop head butting for goodness sake! There are no prizes for those on the sidelines having the right interpretation. No-one here is an actual signatory. It is what the signatories to both the agreement and the announcement understand it to mean that matters.

The above could easily be understood as meaning either:

"An agreement is soon to be made that will include clear and binding terms for both parties that will spell out the way forward. All things being equal, and given the time required to agree on everything both parties want to see included, we expect that such an agreement is likely to be signed within the next 3 months."

i.e. "Within the next 90 days or so we expect to be able to announce that we have made a binding commercial agreement."

Or:

"A binding agreement is being worked on that both parties are happy with. This has been contractually agreed to be signed off on or before 90 days to the minute from the date of this announcement."

i.e. "It is vitally important that we announce a binding commercial agreement within the next 90 days because this timing is a particularly important factor in the agreement."
