Actually just checked MBD, as I'd noticed they always put "highest price allowed" on their buyback notices and they stipulate "under rule 7.33", so I should have read that!!!
For my next question, can companies do "on-market sale" instead of buyback?
I suspect not (or we would have seen it), but it sure would beat the roundabout way of effectively paying La Jolla Cove to do it as a way of raising capital...
... one day I might write to the exchanges and ask the "If not, why not?".
