You are correct at "law". But if there are no resources available to the administrator / receiver and ultimately liquidator their investigations will be very limited. Any breeches of the law are then reported to ASIC and it is up to ASIC (or other authorities) to prosecute. ASIC's record hasn't been great on prosecuting.....
Also there are, unfortunately, a number of insolvency practitioners who will take an appointment and then "bury the company" with the minimum of investigations and report nothing to see here...... Which is why it is important to see who is the insolvency practitioner that is appointed to determine if a "proper" investigation will occur. And to be sure just because a member of a so called big reputable firm is appointed as administrator / receiver and ultimately liquidator doesn't mean that they will not be involved in "burying the company"......
