"Q. Okay. When were the 10 wells that are
currently potential producers put in?
A. They vary. The original -- there's two
original wells that were drilled in the 1950s that
were rehabilitated. There's a third well that was
drilled in '90 something or other that was the
subject of a lawsuit so it was never completed.
There were two other wells that were drilled in at
the turn of the century that were drilled and the
company went bankrupt and never completed them.
Q. Let me stop you right there. Just to
make sure, I'm talking about the 10 producing ones.
A. I am, too. I am, too, if I -- give me
some credit.
Q. I just wanted to make sure because I had
thought that you had said --
A. I really do know what I am doing --
Q. Okay.
A. -- contrary to popular opinion."

"Q. And, in fact, in September of 2014 your
actual production was 230 Mcf; is that correct?
A. That's what it says here, yes.
Q. And you don't have any reason to
disbelieve that?
A. No."

"Q. Okay. In paragraph 18 of Exhibit No. 1,
your declaration, you say that there are 10 active
or producing wells currently. Is that correct?
A. Not today it's not. What page?
Q. It's paragraph 18, which is on page 8.
Paragraph 18 you indicate that Clear Creek -- that
Marion began working to bring the field back into
production, including the drilling or recompleting
10 new wells at the site, which suggested to me
that 10 new wells were in production. Is that not
correct?
A. They were in production. At this point
in time, they're not.
Q. Okay.
A. At this very moment, they're not.
They're going back into production, but at this
very moment they're not.
Q. Is there any production right now?
A. No. Everything is shut in right now
because a quality-of-gas issue.
Q. What do you mean "quality-of-gas issue"?
A. There's a slight -- the pipeline requires
that you have a certain quality of gas. The gas
coming out of the field when all the wells are on
meets the pipeline specs, but when all the wells
are not on, different wells produce different
gases, inert gases, which can sometimes put you out
of spec.
We were out of spec because our biggest
spec well was down requiring some remedial work and
as a result of that the gas went out of spec about
a week ago and so the pipeline shut us in.
The well to get us back into spec will be
repaired in the next day or two. We've bought the
equipment and it will be back in spec.
Q. You anticipate that being just in the
next couple of days?
A. Next few days, yeah."
