When there is clear language that the section does not apply to the actions you have described in relation to the acquisition of shares in ALO, as far as I'm concerned the rest of the section is irrelevant.

I included a link to the legislation. I feel I have not been at all selective in a "marketing" manner whatever you mean by that.

To me "marketing" could be repeatedly pointing to section 45 without acknowledgement of (7).

Your use of holistic as a defence sounds a lot like "it's the vibe".
