Have a look at the Conversion Terms, particularly the clause "ii)", and then compare asymetry of the range of options given to the Note holder to YOUR irrevocable commitment of the capital.
I believe that, particularly the part of that clause referring to the "lowest 5 daily VWAP’s in the 15 trading days prior to conversion", clearly shows who was in a position of strenght in the negotiations of those terms. Sure like hell it was not AAU.
