It is very likely that Bergen have already exited part of or all of this position. They would have done this by shorting the ADR's (Which can be legally shorted) and using this stock to cover. With the volume in the ADR's over the last few days being so high, they could have done this very easily (approx 6m ADR shares is what they would have needed to short). If I am wrong, then 2 things
1. They will need to lodge a substantial notice
2. They are not as smart as I thought....
