By claiming they have been drilling and keeping the results confidential you are admitting they have been breaching disclosure rules as that is what they have been doing in that case.
If AVQ/RM get sued then they can always try to defend themselves by quoting 3.1A maybe saying the drill results were only for internal purposes but they would not convince anyone. Drill results are price sensitive and must be disclosed.
