The request was made to the TGA FOI Mailbox brokered via the service called RightToKnow. Section 27 of the FOI act is in play because the request would relate to Business Information. Section 27 states that the business must be provided the opportunity to make submissions regarding the request.

"Opportunity to make submissions
(4) The agency or Minister must not decide to give access to thedocument unless:
(a) the person or organisation concerned is given a reasonableopportunity to make submissions in support of the exemption contention; and (b) the agency or the Minister has regard to any submissions so made. "

This is the 'response' that they're referring to. Also Borano made multiple submissions due to a misunderstanding. He withdrew the first request and then made a second one. In both cases the above would apply. I wouldn't read to much into that statement other than it's just them responding to the TGA who have to consult them due to section 27.
