Think you're question is potentially not the right one to ask. The turnkey agreement can guarantee they get what they plan for absolutely - does that mean they will get what they planned for? Potentially not.

But what that means is that TMC will then have to do a reproduction at their costs. However, like everything in legal contracts, devil is in the detail, so TMC of course could find a way of arguing that the issues are not in the production of the chip, but in design or use of the chip etc.

In saying all that, the chips have not been mass-produced as of yet so any kinks or performance issues will be factored in and worked out before the second and more important production occurs.
