I may have missed it, but has it ever been explained why the money was put on deposit with a third party trustee and not simply put on a term deposit in the company's name? Governance would suggest you would need a directors' resolution to put that amount of funds on deposit with someone else, and if the directors didn't authorise it, surely they must have asked why this was arrangement was been put in place?
