Their problem isn't the structure they chose but the fact that their are amongst the worst performing funds relative to peers (ishares global metals and producers fund for example). I have rarely seen any comparative destruction of value, while having the audacity to charge 20% of performance above 0 as a fee on top of their guaranteed fee. Ben Cleary is the ultimate spin doctor and will make it sound like his incompetence in stock picking is forever that fault of the market and mines for underperformance. Just look at today's email (commenting on the Gold miners underperformance of the commodity over the past few years, which has forever been the case not just in the past few years).
