IMO, if the new patent application for PBT2 ( Jan 2019, “Processes for the preparation of 8-Hydroxyquinoline Derivatives” ) will be granted ATH will have even longer patent protection for PBT2 than QU will have for the use of PBT2. So if QU will have royalties, ATH will get them as well.
So there would be totally 4 new indications for PBT2:
1. antimicrobial agent
2. heart amyloidosis
3. brain injury
4. tauopathy

All these can be life-threatening conditions. A deal between ATH and QU is perhaps the first step and so QU will be marketing PBT2 for ATH and for itself. 3 other indications cannot get an orphan status and so they need also phase 3 studies. These will take time but if the new patent is granted there will be enough of it. The 3 other indications were the reason to make a new patent application ( was made one month before Prana knew about QU publication). Because of this new PBT2 patent application, Prana could feel safe and actually almost happy, in spite of QU publication. Prana was getting a new interesting indication for its PBT2. At that time QU application was not yet public as it is now. IMO QU is helping ATH to get PBT2 to the market, but for that QU will need a lot of info from ATH. Co-operation is needed.
Now ATH can say in its annual review "In addition to PBT434, Alterity is continuing to explore clinical development options for PBT2 outside the area of neurodegenerative diseases". This what many of us here on the board have been looking for.
