Annexure E, it could be argued, is just an executive summary from the auditor as to how they have assessed the probabilities, weighting, and impact on the year-on-year financials. The words contained here may reflect the instructions given to them from the board, but (it could be argued) carry no legal weighting.

The lawyers will probably indicate that what was voted on at the AGM is as per the milestone descriptions in Resolutions 4,5,6. Hence Glyn's words "Milestone 2 is as stated".


While it is disappointing that Glyn has apparently not honoured his sentiment in your email to you, Smac, the lawyers will probably again argue that the contents do not supersede Resolutions 4,5,6.
